1

Purpose

This is a translation provided for your convenience. In case of discrepancy, the French version prevails.

These general terms of sale govern the booking, on the trouvemoi.eu platform, of leisure activities and services offered by professional providers, the sale of gift vouchers and the subscriptions taken out by professionals.

They apply to any order placed on the platform. Placing an order implies unreserved acceptance of these terms, in the version in force on the day of the order.

2

TrouveMoi’s role

TrouveMoi is an intermediation platform. Unless explicitly stated otherwise, the service contract is concluded between you and the provider offering the activity, who alone is responsible for its performance, safety and compliance with the published description.

TrouveMoi provides the platform and forwards your booking request to the provider. TrouveMoi does not collect the price of services: you pay it directly to the provider, who is its sole recipient, and no money relating to a service goes through TrouveMoi’s accounts. A question about how the activity takes place, its price, payment or refund is therefore for the provider; a question about how the platform works is for us.

3

Prices

Prices are shown in euros, all taxes included. They cover the service described on the activity page, excluding anything not expressly mentioned, in particular transport to the meeting point.

The applicable price is the one displayed when the order is confirmed. A later change in the price of an activity has no effect on orders already confirmed.

4

Placing an order

A booking follows these steps: choice of the activity, date and number of participants; review of the summary, which can be corrected until confirmation; acceptance of these terms; sending of the request to the provider; confirmation by the provider.

The service contract is formed between you and the provider when the provider confirms your booking; you are informed by notification and by email. The confirmation summarises the service, the date, the number of participants and the amount due to the provider.

5

Payment

The price of a service is paid directly to the provider, using one of the means the provider offers, shown to you when booking (online payment link on the provider’s own account, PayPal, bank transfer, payment on site…), on the terms and schedule the provider sets. TrouveMoi collects no money for services, takes no commission on them and plays no part in their payment.

Only gift vouchers and professionals’ subscriptions are paid to TrouveMoi, online, through our provider Stripe: your bank details do not go through our servers and are never stored on them.

6

Gift vouchers

Gift vouchers are personal, valid for twelve months from their date of issue and usable on the eligible activities indicated at the time of purchase. They cannot be taken back, exchanged or refunded, including in case of loss, and no change is given if the price of the chosen service is lower than the amount of the voucher.

A voucher can be used several times until its amount is used up, within its period of validity.

7

Right of withdrawal

Leisure services booked for a specific date or period are not subject to the fourteen-day right of withdrawal. This exclusion is provided for in point 12 of Article L221-28 of the French Consumer Code, which covers leisure services provided on a specific date or at a specific frequency. You are reminded of it before confirming your order.

The fourteen-day right of withdrawal does, however, apply to the purchase of a gift voucher not assigned to a date. To exercise it, send an unambiguous statement to contact@trouvemoi.com within fourteen days of purchase; you will be refunded within fourteen days of receipt of your request, using the same means of payment.

8

Cancellation and changes

The cancellation terms specific to each activity are shown on its page and reminded to you before you send your request. Unless stated otherwise, a cancellation request sent more than forty-eight hours before the start of the service gives rise to a full refund of the sums paid; after that, the service remains payable. The refund is made by the provider, who received the payment.

Failure to show up without prior cancellation gives rise to no refund.

If the provider cancels the service, for whatever reason, the provider refunds the sums paid in full and without delay, without prejudice to any other claim you may have against the provider.

9

Professionals’ subscriptions

Professionals may subscribe to the platform’s services. The price and billing period (monthly or yearly) are shown before subscribing. The subscription is paid to TrouveMoi, online, through Stripe (bank card or any other means offered on the payment page), and renews automatically at each due date.

The subscription can be cancelled at any time from the professional area; cancellation takes effect at the end of the current, already paid, period. The subscription involves no commission on services, which professionals collect directly from their clients.

10

Participant’s obligations

You must show up at the place and time indicated, follow the provider’s safety instructions and declare that you are able to take part in the chosen activity. The provider may refuse the participation of a person who is clearly unfit or whose behaviour endangers the group, without refund.

11

Liability

TrouveMoi is responsible for the proper functioning of the platform and for the accurate transcription of the information provided by providers. Responsibility for performing the service lies with the provider.

Neither party can be held liable for a failure due to force majeure within the meaning of Article 1218 of the French Civil Code.

12

Complaints and mediation

Any complaint can be sent to contact@trouvemoi.com or by phone on 07 45 15 54 51. We acknowledge receipt within forty-eight working hours.

In accordance with Article L612-1 of the French Consumer Code, you may use a consumer mediator free of charge to settle a dispute amicably, after trying to resolve it directly with us. The contact details of the mediator chosen by the publisher will be published here as soon as it is appointed.

The European online dispute resolution platform is also available at ec.europa.eu/consumers/odr.

13

Governing law

These terms are governed by French law. In the event of a dispute, the French courts have jurisdiction under the conditions laid down by the Code of Civil Procedure and the Consumer Code. These provisions do not deprive consumers of the mandatory protection granted to them by the law of their habitual residence.
